Complete the “Duty of Health Care Providers” Toolwire scenario. Access the scenario by clicking the linked Toolwire activity title. Use the information in the scenario as a supporting resource for this part of the assessment.
In Part 1 of your assessment, be sure to address the following:
Describe differing kinds of informed consent that may be applicable, and assess decision-making capacity as it pertains to informed consent and the patient.
Classify different types of general and professional liability.
Describe the elements of negligence that must be present in order for a plaintiff to recover damages such as:
Duty to care.
Breach of duty.
To prepare for this part of the assessment, read Croke’s 2006 article, “Nursing Malpractice: Determining Liability Elements for Negligent Acts,” which is linked in the Resources.
After reading the article, complete the following:
Identify and describe the following elements of the cases presented in the article:
The duty to provide care.
When and how the breach of duty occurred.
The extent of the injury.
The damages as a result of the injury.
Assess the impacts of regulation on patient care and injury prevention strategies.
Discuss how the incident could have been prevented. What steps would you take?
